Closing Credit Offer Terms
As part of our service, we may provide a credit toward your closing costs, funded from the sales commission we receive from the builder/developer (or the builder’s broker) upon successful closing of your purchase.Important Conditions and Disclaimers
- No Obligation to Provide Credit: We are under no obligation to offer or provide any savings credit or contribution toward closing costs in any transaction. Any potential credit discussed, advertised, shown in our calculator, or referenced on this website or in communications is discretionary and subject to our final determination.
- Conditional on Builder Commission: Any savings credit we may elect to provide is strictly contingent upon the builder (or the builder’s authorized representative) paying us a sales commission that exceeds the amount of the proposed credit by at least 50%. For example, if we were to offer a $5,000 credit, the commission we receive from the builder must be at least $7,500 (credit amount + 50% buffer) for us to proceed with providing that credit. This buffer helps cover our operational costs, risks, and brokerage responsibilities. Our typical credit covers 80% of the cost of most common title charges, such as owners policy and common residential endorsements.
- Calculator Estimates Only: Any estimated closing costs or potential savings displayed by our online calculator are illustrative and based on general assumptions, average data, and/or user inputs. They do not constitute a guarantee, promise, or binding offer of any specific credit amount. Actual closing costs vary based on the specific property, purchase price, lender requirements, builder incentives, and other factors. Any potential savings credit is determined case-by-case after contract execution and confirmation of the builder-paid commission.
- Negotiable and Transaction-Specific: Real estate commissions and any related credits or concessions are fully negotiable and not set by law. The availability and amount of any credit depend on the specific builder’s commission structure for the project, the terms of our cooperation with that builder, and the successful closing of your purchase through our representation. We do not control builder commission offers. Every transaction is unique.
- No Impact on Your Obligations: Nothing in our services or any potential credit relieves you of your responsibility to pay any required fees, costs, or obligations under your purchase contract, loan terms, or applicable law. If a credit is provided, it will typically appear as a credit to buyer on the closing disclosure/settlement statement.
- Changes or Withdrawal: We reserve the right to modify, suspend, or withdraw this credit offering (including any advertised or calculated estimates) at any time without notice, including mid-transaction if builder commission details change or do not meet the required threshold.

New Build Buyer Realty, LLC (a licensed Florida real estate brokerage operating NewBuildBuyer.com) may provide buyers with periodic updates on construction progress for properties where we represent the buyer. These updates may include third-party drone footage and/or aerial imagery, provided such activities are legally permitted under applicable laws, including Federal Aviation Administration (FAA) regulations (e.g., Part 107 for commercial operations) and Florida Statutes (including but not limited to §934.50 regarding drone usage and privacy expectations on private property).
- Requirements and Approvals: Drone operations require prior approval from the FAA (where applicable), the builder/developer, and any relevant homeowners’ association (HOA), community, or local authorities. We do not conduct drone flights ourselves; any footage is obtained exclusively by independent, licensed third-party drone operators who comply with all federal, state, and local regulations.
- Ownership and Discretionary Sharing: All drone footage and related imagery obtained through these third-party services remains the property of New Build Buyer Realty, LLC. We share such footage with clients at our sole discretion, and only where permitted by law, builder agreements, and privacy considerations. Footage is provided for informational purposes only and is not intended as a formal record, survey, or substitute for professional inspections.
- Analysis of Footage: We may review drone footage using human analysis and/or artificial intelligence (AI) tools to identify potential visible defects, construction issues, or other observations. However, we make no representations, warranties, or guarantees regarding the completeness, accuracy, or reliability of any such analysis. Drone footage is limited in scope (e.g., aerial views only, subject to weather, angles, resolution, and timing), and many defects may not be detectable from the air, even if present. AI analysis is an emerging tool with inherent limitations and potential for errors or omissions. We disclaim any liability for failure to identify issues, misinterpretations, or reliance on such reviews. Buyers are strongly encouraged to conduct their own independent professional inspections.
- No Liability for Third-Party Services: Any drone-related services are provided by independent third parties not affiliated with or controlled by New Build Buyer Realty, LLC. We do not assume responsibility for the quality, compliance, safety, or results of these third-party operations.
Third-Party Home Inspections
Where permitted by the builder, applicable laws, and the specific property/community, we may facilitate or recommend a home inspection (or phase inspections) performed by a certified, independent third-party home inspector licensed and servicing the relevant area in Florida.
- Third-Party Nature: These inspections are conducted solely by independent professionals. We do not perform the inspections ourselves and make no claims, warranties, or guarantees as to the accuracy, thoroughness, completeness, or reliability of any inspection report, findings, or recommendations.
- Informational Only: Any inspection arranged or referenced through us is provided for your information and convenience only. It does not constitute a warranty, guarantee, endorsement, or assurance by New Build Buyer Realty, LLC regarding the condition of the property. Buyers remain fully responsible for reviewing inspection reports, addressing any concerns, and making their own decisions about the purchase.
- Limitations: Home inspections have inherent limitations (e.g., non-invasive, visual-only in many cases) and may not detect all defects, hidden issues, or future problems. We disclaim any liability arising from the inspection process, report content, or any reliance thereon.

Other Terms & Conditions
These Terms and Conditions (“Terms”) govern your access to and use of the website located at NewBuildBuyer.com (the “Site”), operated by New Build Buyer Realty, LLC, a Florida real estate brokerage owned and operated by David VanderVoort, Broker (“we,” “us,” “our,” or the “Brokerage”).
